Sole Mandates vs Open Mandates

Choosing the Right Seller Mandate When Selling Your Home

Choosing the right seller mandate is one of the most important decisions you’ll make when selling your home. Yet it’s often made without fully understanding how it affects agent accountability, marketing effort, buyer perception, and ultimately, the price you achieve.

Watch The Video:

There is no universal “right” or “wrong” mandate. What matters is choosing the mandate that best suits your circumstances, expectations, and timeline.

On this page, we explain the most common seller mandate options used in South Africa—and, more importantly, how each one influences the way your property is marketed, managed, and positioned in the market.

In the video, André explains:

  • The real difference between sole mandates and open mandates
  • Why open mandates often seem attractive but can work against sellers
  • How mandate structures influence agent behaviour
  • Why a sole mandate only works when the right agent is chosen
  • What effective, modern property marketing looks like today
  • Why trust, communication, and alignment matter throughout the sale

This is a practical, straight-talking explanation designed to help sellers make informed decisions—before signing anything.

The Main Types of Seller Mandates in South Africa

1. Sole Mandate (Exclusive Mandate)

A sole mandate means you appoint one agent or agency exclusively to market and sell your property for a fixed period—typically 30, 60, or 90 days.

This structure creates clear accountability and allows the agent to take full responsibility for marketing, buyer management, and negotiations.

With a sole mandate:

  • One agent controls all enquiries and viewings
  • Pricing and messaging remain consistent
  • The agent can confidently invest in marketing
  • Buyer interest and feedback are properly tracked
  • The risk of commission disputes is significantly reduced

A sole mandate works best when it’s paired with:

  • A proven agent with strong local knowledge
  • A clear, written marketing strategy
  • Regular feedback and transparent communication

By law, sole mandates must be in writing, clearly state the mandate period, and define the commission structure.

2. Joint Sole Mandate

A joint sole mandate operates much like a sole mandate, except that two agents are appointed together under one exclusive agreement.

This approach is sometimes used when:

  • Two agents bring complementary strengths
  • Different buyer networks are combined
  • Roles and responsibilities are clearly defined upfront

From a seller’s perspective, a joint sole mandate still offers:

  • Structured marketing
  • Clear accountability
  • Controlled exposure
  • Reduced legal risk

The key to success here is clarity. Roles, responsibilities, and commission splits must be agreed to in writing to ensure smooth cooperation and avoid misunderstandings.

3. Open Mandate (Non-Exclusive Mandate)

An open mandate allows you to appoint multiple agents at the same time, and you may also sell the property privately.

While this structure feels flexible, it often comes with practical challenges.

With an open mandate:

  • No single agent has full accountability
  • Agents are reluctant to invest heavily in marketing
  • Pricing and online exposure can become inconsistent
  • Buyer management is fragmented
  • The risk of commission disputes increases

In practice, open mandates often result in agents competing with one another rather than working strategically for the seller. This can affect both the quality of buyers introduced and the final outcome of the sale.

Why Your Mandate Choice Matters

The mandate you choose directly impacts:

  • How much effort and marketing investment your agent can justify
  • How buyers perceive your property in the market
  • The level of control over pricing and negotiations
  • The overall professionalism and smoothness of the process

A mandate is not just a form to sign—it’s the framework for how your entire sale is handled.

Our Approach

Our role is not to push sellers toward a specific mandate.

Our role is to:

  • Explain each option clearly and honestly
  • Help you understand the real-world implications
  • Design a marketing strategy that fits your goals
  • Guide you calmly and professionally from start to finish

When sellers understand the process, they make better decisions—and achieve better results.
